Short answer

"Bioengineered" is the USDA’s official term for food containing detectable modified genetic material. It replaced "GMO" on US labels in 2022. The disclosure has broad exemptions covering refined ingredients like sugar and oil, most meat and egg products, and small manufacturers, so many GMO-derived foods carry no label at all.

What "bioengineered" means

Under the US National Bioengineered Food Disclosure Standard, mandatory since January 2022, a bioengineered food contains genetic material that has been modified through certain laboratory techniques and where that modified DNA is detectable in the final product.

The USDA chose "bioengineered" over "GMO" deliberately. The stated reason was technical precision. The practical effect was to put an unfamiliar word on packaging in place of one consumers had strong existing associations with, and it is reasonable to notice that.

Disclosure can take any of four forms:

  1. Text: "Contains a bioengineered food ingredient"
  2. The USDA's green-and-white BE symbol
  3. A QR code or digital link
  4. A text-message number to request the information

Options three and four are the ones that draw criticism, because they place the information behind a device and a data connection rather than on the packet.

The exemptions matter more than the rule

This is the part that surprises people, and it is why a disclosure label tells you much less than it appears to.

Highly refined ingredients are exempt when no modified DNA remains detectable. That covers refined beet sugar, most vegetable and canola oils, and corn syrup, which are among the highest-volume GMO-derived ingredients in the food supply. They come from bioengineered crops and they carry no disclosure.

Meat, poultry and egg products are largely exempt, including animals raised entirely on GMO feed.

Small manufacturers below a revenue threshold are exempt.

Restaurant and food-service food is exempt.

Put together: a product with no bioengineered disclosure may still contain ingredients derived from bioengineered crops. The label is not a guarantee. Non-GMO Project Verified or certified organic are the stronger signals, because they address sourcing rather than DNA detectability.

Which crops are bioengineered

The USDA maintains a List of Bioengineered Foods. In practice, the commercially significant ones are:

If a product contains corn, soy, canola or sugar-beet derivatives and is not organic or Non-GMO Project Verified, the odds of a bioengineered origin in the US supply are high, disclosure or not.

Europe is a different regime entirely

The EU takes the opposite approach. GMO content above 0.9% must be labelled, the labelling applies regardless of whether DNA remains detectable, and very few GM crops are approved for cultivation. As a result, GM labelling is rare on EU shelves. That is not because it is hidden, but because the products largely are not sold there.
